Suspensión de la pena privativa de libertad

Abstract

El presente trabajo aborda el estudio de la figura de la suspensión de la ejecución de la pena privativa de libertad. Empezaremos viendo cómo esta ha experimentado numerosos cambios a lo largo de nuestra regulación y las razones que fundamentan su continuidad en nuestros días. Veremos las numerosas novedades que sobre esta materia se introducen tras la reforma de 2015 gracias a la Ley Orgánica 1/2015, de 30 de marzo, así como el establecimiento de un único régimen de suspensión, pudiendo diferenciar entre un régimen general u ordinario y otros especiales, atendiendo a diversas circunstancias. Todo ello sin perder el principal objetivo de esta figura que será la resocialización y rehabilitación del penado, pretendiendo así que este no vuelva a delinquir.

This work deals with the study of the figure of the suspension of the execution of the custodial sentence. We will start by seeing how it has undergone numerous changes throughout our regulation and the reasons that support its continuity today. We will see the numerous novelties that on this matter are introduced with the 2015 reform thanks to Organic Law 1/2015, of March 30, as well as the establishment of a single suspension regime, being able to differentiate between a general or ordinary regime and others. special, attending to diverse circumstances. All this without losing the main objective of this figure, which will be the re-socialization and rehabilitation of the convicted person, thus pretending that he does not commit a crime again.
