PRIVILEGIOS E INMUNIDADES PROCESALES DE LOS CARGOS PÚBLICOS EN ESPAÑA

Abstract

[ES]La prerrogativa del aforamiento se encuentra regulada en la Constitución Española y en diversas leyes en una ampliación que realiza el legislador para determinados cargos. Consiste en ser juzgado por un Tribunal superior. El objeto es el de proteger a la institución durante la vigencia del cargo. Los fundamentos para justificar su presencia en nuestro país no son proporcionales para limitar el principio de igualdad ante la ley. Hoy en día, el gran número de personas que gozan de esta prerrogativa está desvirtuando el fundamento para el que fue creada, creando la confusión entre privilegio y protección. El número de aforados en nuestro país ha sido objeto de una fuerte polémica en los últimos tiempos en España. La mención al Derecho comparado, muestra que las leyes de nuestro país en esta materia no se adaptan a las exigencias de los países de nuestro entorno.
