LA EXTINCIÓN DEL RÉGIMEN LEGAL DE DIVISIÓN HORIZONTAL Y LA DIVISIÓN DE LA COSA COMÚN

Resumen
[ES] El presente trabajo versa sobre un edificio, sujeto al régimen legal de división horizontal y,
más tarde, declarado en ruina por resolución administrativa firme; a continuación, sus
dueños pactaron, de mutuo acuerdo, el completo derribo del inmueble, así como la ulterior
extinción del precitado régimen de división horizontal. La parcela resultante, tras dicha
demolición, se rige por el régimen legal de la “comunidad de bienes”. Así, este dictamen
analiza el procedimiento administrativo, declaratorio de ruina, amén de la subsiguiente
extinción de la propiedad horizontal, en sede judicial; también se aborda, acto seguido, el
respectivo procedimiento de división de la “cosa común” ante los Juzgados, mediante la
oportuna “actio communi dividundo”.
[EN] The present work deals with a building, subject to the legal regime of “horizontal division” and, later, declared in ruin by firm administrative resolution; next, their owners agreed, by mutual agreement, the complete demolition of the property, as well as the subsequent extinction of the aforementioned “horizontal division” regime. The resulting plot, after said demolition, is governed by the legal regime of the "community property". Thus, this opinion analyzes the administrative procedure, declaratory of ruin, in addition to the subsequent extinction of horizontal property, in court; the respective procedure of division of the "community property" before the Courts is also addressed, by means of the opportune "actio communi dividundo".
