EL ESTADO DE NECESIDAD HOY ANTE LAS SITUACIONES DE PENURIA ECONÓMICA

Abstract

[ES] Nos adentramos en un comentario sobre la Situación de Necesidad Justificante. El número de personas que acuden a los tribunales alegando encontrarse en un estado de necesidad ha ido aumentando en los últimos años. El objetivo principal ha sido reconocer cuáles son los principales motivos empleados por los Tribunales para aplicar la eximente incompleta en vez de la eximente completa en los distintos delitos. Para poder aplicar la eximente completa, y así prevenir cualquier imputación, es necesario el agotamiento de vías lícitas, vías públicas proporcionadas por el Estado y Entidades Privadas, el cual es necesario que quede acreditado. Esto último se debe a que existe un gran número de casos en los que se desestimaban por carencia de pruebas.

[EN] We enter into a comment on the Situation of Justifying Necessity. The number of people who go to court claiming to be in a state of need has been increasing in the last years. The main objective has been to recognize what are the main reasons used by the Courts to apply the incomplete exemption instead of the complete exemption in the different crimes. In order to apply the full exemption, and prevent any imputation, is necessary the exhaustion of legal routes, public roads provided by the State and Private Entities, which is necessary to be accredited.
