La guarda y custodia compartida en los procesos de separación y divorcio, en España

Abstract

[ES]La custodia compartida o conjunta significa que ambos padres comparten todo lo que necesiten sus hijos para su desarrollo integral, hijos menores o incapacitados judicialmente , la parte que más sufre en estos procesos de rupt ura matrimonial y de la convivencia. Este Trabajo Fin de Grado pretende, en primer lugar, analizar la situación actual de la guarda y custodia compartida de los hijos en los procesos de separación y divorcio, tanto a nivel estatal, con la regulación del Código Civil español, como a nivel autonómico, a través de las leyes regu ladores de esta figura jurídica en algunas Comunidades Autónomas como Aragón o Navarra. En segundo lugar, pretende mostrar las princi pales novedades que quiere introducir en esta materia el Anteproyecto de Ley sobre el ejercicio de la corresponsabilidad parental en caso de nulidad , separación y divorcio.

[EN]Shared custody means that both parents share the legal and physical custody of their child or children, who are the part that suffers the most in this breaking process. This end of degree essay aims at analysing the current situation of children shared custody in the process of separation and divorce, both at the state leve!, with the regulation of the Spanish Civil Code, and at the regional leve!, through the regional laws which regu late this legal concept in sorne Local Communities such as Aragón or Navarra . This essay also intends to show the mam changes or innovations of the refonn that the prel iminary draft law about the exercise of the parental co-responsibility in case of nullity, separation and divorce aims at in the field of shared custody in the Spanish Civil Code.
