LOS PRINCIPIOS JURÍDICOS DEL DERECHO

Abstract

[ES] En este trabajo he tratado de abordar un importante tema como es el de los principios jurídicos del derecho. En primer lugar, he desarrollado la definición de principio jurídico, puesto que varios autores lo conceptúan de manera diferente. En segundo lugar, he hecho un análisis de sus características, ámbito de aplicación, su valor jurídico y la eficacia de los mismos con varias figuras : las reglas, los valores, los derechos subjetivos y las directrices. También he enumerado cuáles son sus funciones y como se clasifican según su generalidad, según la materia, según su regulación y según su función. Seguidamente, he realizado un estudio de la jerarquía y criterios de la resolución de conflictos, como se ponderan y algunas sentencias de conflictos entre principios. Y por último, una serie de conclusiones a las que he podido llegar tras haber realizado este trabajo.

[EN] With this work i have tried to adress an important issue such as the legal principles of law. First, I have developed the definition of legal principle, since several authors conceptualize it differently. Secondaly, i have made an analysis of its characteristics, scope of application, its legal value and the effectiveness of them with several figures : the rules, the values, the subjective rights and the guidelines. Also what are their functions and how they are classified according to their generality, according to the subject, according to their regulation and according to their function. Next, i have made a study of the hierarchy and criteria of the resolution of conflicts and how they are weighted and some sentences of conflicts between principles. And finally, a series of conclusions that i have been able to reach after having done this work.
