PRESCRIPCIÓN DEL DELITO

Abstract

[ES] A continuación vamos a exponer un trabajo de fin de grado basado en la institución de la prescripción del delito. Esta institución esconde un sinfín de problemáticas que han sido resueltas y que otras no. Para eso haremos un recorrido a lo largo de esta institución, basándonos en primer lugar en su origen. Es importante que nos remontemos a su origen para conocer con más exactitud de donde proviene esta magnífica institución. Más tarde nos ocuparemos de donde está regulada la prescripción y por supuesto de su naturaleza, la cuál se divide en naturaleza sustantiva, procesal y mixta y haremos hincapié en la naturaleza jurídica según el tribunal supremo. Por supuesto, es muy importante que no olvidemos estudiar el fundamento de esta institución y aquí daremos un paseo sobre la teorías más importantes, las cuáles unas justifican su naturaleza sustantiva y otras justifican su naturaleza procesal. Pero no todos los autores están a favor de esta institución y por lo tanto eso lo haremos ver mediante unos argumentos contrarios a esta. Cabe destacar que no podemos olvidarnos de los principios de la prescripción del delito y por supuesto de diferenciar esta institución con otras figurar afines. Por último acabaremos con el plazo de la prescripción, su cómputo e interrupción, junto con una conclusión sobre esta valiosa institución.
