Intimidad y nuevas tecnologías en el ámbito laboral.

Abstract

Las nuevas tecnologías han afectado considerablemente al Derecho del Trabajo, dando lugar a nuevas formas relaciones laborales. Por lo que se ha visto necesario acudir a las nuevas tecnologías para utilizar herramientas que permitan controlar la prestación laboral. Como consecuencia de ello, los derechos fundamentales de los trabajadores se han visto afectados, sufriendo una intromisión a su esfera más íntima, que en ocasiones puede ser justificada, pero en otras no. Se hace necesario trazar los límites de los derechos fundamentales de los trabajadores y valorar el alcance del poder de dirección y control que ostenta el empresario sobre los trabajadores.

New technologies have considerably affected Labor Law, giving rise to new forms of labor relations. Therefore, it has been necessary to resort to new technologies to use tools that allow to control the labor provision. As a consequence, the fundamental rights of workers have been affected, suffering an intrusion into their most intimate sphere, which can sometimes be justified, but sometimes not. It is necessary to draw the limits of the fundamental rights of workers and assess the extent of the power of direction and control that the employer has over the workers.
