RESPONSABILIDAD CIVIL DERIVADA DEL USO Y CIRCULACIÓN DE VEHÍCULOS DE MOTOR: ESPECIAL REFERENCIA AL HECHO DE LA CIRCULACIÓN Y CAUSAS DE EXONERACIÓN

Abstract

En el presente trabajo se estudiará el régimen sobre el que se sustenta la responsabilidad civil derivada del uso y circulación de vehículos de motor. En primer lugar haré un recorrido normativo en la evolución que a lo largo de los años ha ido sufriendo esta materia debido, principalmente a la necesidad de incorporar a nuestro derecho interno las diferentes directivas europeas.

Posteriormente, se analizará los diferentes elementos que conforman el régimen jurídico contenido en el RDLeg 8/2004. Además profundizaremos en el denominado "hecho de la circulación", contenido en el RD 1507/2008, elemento clave junto con el de "vehículo a motor" para poder estudiar correctamente la LRCSVM.

Finalmente, al encontrarnos en un sistema de responsabilidad objetiva es de vital importancia un estudio en profundidad de las causas de exoneración en el ámbito del uso y circulación de vehículos de motor.

Inthis document, we will study the regime of the civil liability for the use and circulation of motor vehicles. First I'll do a quick study in the normative evolution that over the years has undergone this theme due to the need to incorporate into our domestic law the various European directives. Then, the different elements about the regime in the RDLeg 8/2004 will be analyzed. Moreover, we will study in depth about "the fact of circulation" contained in RD 1507/2008 with the other important element that is called "motor vehicle" for study correctly the LRCSVM. Finally, to study a system of strict liability is very important a depth study in the causes of exemption in the area of the use and circulation of motor vehicles.
