Resumen
[ES] En el presente Trabajo Fin de Grado estudiaremos la posibilidad de registrar un olor como marca. Trataremos de saber si es posible registrar un olor o está prohibido. Para averiguarlo veremos el tema del olor en el mundo comercial, la legislación europea y española relativa a este tema junto con ciertas referencias a la interpretación que la jurisprudencia hace sobre esta cuestión.
A lo largo del trabajo deberemos ver el concepto de marca, sus requisitos y funciones y, principalmente, veremos si se permite un
uso exclusivo del olor para un único operador del mercado y, de ser así, tendremos que saber cuáles son los requisitos necesarios
para poder registrar dicho uso exclusivo.
Concluiremos determinando la posibilidad de registrar como marca un signo cuyo elemento esencial sea el olor.
[EN] In this final Project we will study the possibility to register a smell as a trademark. We will try to know if it is possible to register a smell or is prohibited. To find out, we shall see the issue of odor in the commercial world, European and Spanish legislation on this issue together with some references to the interpretation that law makes on this issue. Throughout the work we must see the brand concept, its requirements and functions and mainly if an exclusive use of smell for a single market operator is allowed and, if so, we should know what the requirements are to register that exclusive use. We will conclude by determining the possibility of registering as a trade mark whose essential element is the smell.
