Resumen
[ES] En este Trabajo Fin de Grado dedicado a la “Tutela Judicial Efectiva y a la Mediación en la Empresa Familiar”, se estudia si este derecho fundamental está presente en los métodos alternativos de resolución de conflictos y, en caso de no estarlo, si habría que modificarlo.
Se estudia la repercusión que tiene la empresa familiar en España, la familia y la empresa y los conflictos que se dan en ella por la relación entre los miembros. Para su resolución existen distintos métodos y en este trabajo se estudia concretamente el de mediación.
Respecto a la mediación, se ha estudiado su evolución legislativa, los principios que la componen, la figura del mediador y el Protocolo Familiar.
Por último, el Protocolo Familiar, donde se analizan los objetivos, el proceso de elaboración y su contenido, realizando una distinción entre la Asamblea Familiar y Consejo Familiar.
[EN] In this Final Degree Project dedicated to "Effective Judicial Guardianship and Mediation in Family Business", it is studied if this fundamental right is present in the alternative methods of conflict resolution and, if it is not, if it should be modified . The repercussion of the family business in Spain, the family and the company and the conflicts that occur in it due to the relationship between the members are studied.
