Las diligencias preliminares de investigación que afectan a derechos fundamentales en el art. 18 CE con especial atención a la figura del agente encubierto

Abstract

[ES] En este trabajo se trata de acercar la figura del agente encubierto, y explicar cada una de sus características y principios que debe de respetar durante el desarrollo de la investigación, y la duración de la misma. Además de estudiar la modificación llevada a cabo por la LO 13/2015 y Ley 41/2015 que introduce la figura del agente encubierto informático para la persecución de delitos en internet.

[EN] In this paper we try to approach the figure of the undercover agent, and explain each of its characteristics, the principles of the investigation, and the duration of it. In addition to studying the modification carried out by the LO 13/2015 and the Law 41/2015 the figure of the undercover computer agent for the prosecution of crimes on the internet is presented.
