UNA VISIÓN PARTICULAR DEL DELITO DE ABANDONO DE LAS MESAS ELECTORALES

Abstract

[ES]El fraude electoral se ha extendido desde principios del siglo XX, hasta que el actual sistema democrático español, desarrolló conductas delictivas para el correcto funcionamiento electoral a través de la Ley Orgánica del Régimen Electoral General 5/1985, de 19 de junio, reformada por la vigente Ley Orgánica 2/2011, de 28 de enero, cuyos objetivos principales son asegurar el orden, regularidad y transparencia que abarca el ejercicio del derecho de sufragio en las consultas electorales y los distintos sujetos que forman los mismos, centrándonos en el especial análisis de las particularidades y jurisprudencia sobre el delito de abandono de las mesas electorales del art. 143 de la Ley.

[EN]Electoral fraud has spread since the beginig of XX century, until the current Spanish democratic sytem developed criminal conduct for the right functioning through the Organic Law General Sytem Electoral 5/1985 Juin 19th, reformed by the current Organic Law 2/2011 January 28th whose main aims are to ensure the order, regularity and transparency that covers the exercise of the law to vote in electoral query and the different subjects that from the same, focusing on the special analysis of the particulatiries and jurisprudence of abandonment crime of electoral table, article 134 of the Law.
