LA IMPRUDENCIA EN LA REFORMA DEL CÓDIGO PENAL DE 2019

Abstract

[ES] Se pretende con este estudio el análisis de la reforma de 2019 en materia de imprudencia, la cual surge por el aumento de accidentes en los que resultan afectados peatones y ciclistas, las causas por las que se implanta y la comprobación de su viabilidad. Para ello, partimos de la regulación que existía en el Código Penal de 1995 en materia de imprudencia, que se clasificaba en imprudencia grave y leve, con la existencia de las faltas. Y por supuesto, teniendo muy presente la reforma de 2015, que se llevó a cabo con ánimo de reservar al ámbito penal las conductas más graves, respetando el principio de intervención mínima. En la reforma de 2015 se suprimieron las faltas, se produjo un endurecimiento de las penas y se creó la figura de la imprudencia menos grave, cuestión en la que es necesario centrarse debido a su complejidad de interpretación.[EN] The aim of this study is to analyse the 2019 recklessness reform, which arises from the increase in accidents involving pedestrians and cyclists, the causes for which it is implemented and the verification of its viability. In order to do this, we started from the regulation that existed in the Criminal Code of 1995 regarding recklessness, which was classified as serious and slight recklessness, with the existence of faults. And of course, bearing in mind the 2015 reform, which was carried out with the aim of reserving the most serious conduct to the criminal sphere, respecting the principle of minimum intervention. In the 2015 reform, misdemeanours were abolished, penalties were stiffened and the figure of the least serious recklessness was created, an issue on which it is necessary to focus due to the complexity of its interpretation
