Las medidas cautelares son “el remedio arbitrado por el Derecho para evitar los riesgos que la duración del proceso puede implicar para la efectividad de la tutela judicial que pudiera otorgarse en una eventual sentencia estimatoria”. De modo que, formarán parte integrante del contenido esencial del derecho fundamental a la tutela judicial efectiva dispuesto en el artículo 24.1 CE, pues según el Tribunal Constitucional: “la tutela judicial no es tal sin medidas cautelares adecuadas que aseguren el efectivo cumplimiento de la resolución definitiva que recaiga en el proceso”.
[EN] The precautionary measures are "the remedy refereed by law to avoid the risks that the duration of the process may involve to the effectiveness of the judicial protection which could be granted in an eventual positive statement". So, they will form an integral part of the essential content of the fundamental right to effective judicial protection provided in article 24.1 CE, because according to the Constitutional Court: "judicial protection is not so without measures precautionary appropriate to ensure the effective implementation of the final resolution, falling in the process".
