Abstract

[ES] El presente dictamen trata sobre un particular, Dª. Concepción, que suscribe contrato de seguro en un banco, que cubre entre otras, la invalidez. En el momento de su firma, la tomadora estaba en situación de alta laboral, habiendo estado anteriormente de baja una semana, debido a unas migrañas, causando alta por mejoría o curación. Posteriormente, causa baja laboral, diagnosticada de algia facial, siendo definitivamente diagnosticada de cefalea en racimos, por lo cual es declarada por el INSS incapacitada en grado absoluto para cualquier profesión. Dª Concepción, efectúa reclamación amistosa,denegando la aseguradora la prestación y alegando que padecía lesiones con anterioridad a suscribir el contrato y que fueron ocultadas en el cuestionario de salud siendo dicho cuestionario cumplimentado por la empleada del banco y definitivamente firmado y aceptado por la tomadora. A tal efecto, procedo a hacer estudio de la viabilidad de la reclamación judicial haciendo hincapié en determinados puntos.
