DOMICILIO CONYUGAL, PENSIONES DE ALIMENTOS Y COMPENSATORIA Y USO DE LAS MEDIDAS PROVISIONALES EN LOS PROCEDIMIENTOS DE DIVORCIO CONTENCIOSO

Abstract

[ES] El divorcio es una de las causas de disolución del vínculo matrimonial. Con el paso del tiempo, la materia en este supuesto ha ido avanzando por los cambios que se han producido en la sociedad, y ello ha dado lugar a importantes reformas legislativas. La Ley 15/2005 de 8 de julio, por la que se modifican el Código Civil y la Ley de Enjuiciamiento Civil en materia de separación y divorcio1 junto con la Ley 15/2015, de 2 de julio, de la Jurisdicción Voluntaria2, han traído consigo grandes cambios. En el presente dictamen se procederá al estudio de las circunstancias de un particular, ante la vivencia de una crisis matrimonial, que acarrea la interposición de una demanda de divorcio contencioso, así como de las cuestiones que se plantean para proceder a la defensa de sus derechos e intereses.

[EN] Divorce is one of the main ways to dissolve marriage. Over time, this field has evolved to adapt to changes in society. For this reason, the existing legislation is meant to change. The reform of the law 15/2005 (8th July) resulted in modifications in the Civil Code and in the Code of Civil Procedure in relation to separation and divorce. The previous reform and the one applied to the law on Voluntary Jurisdiction 15/2015 (2nd July) brought with them dramatic changes. The special circumstances during a real marital crisis are studied here. This marital breakdown resulted in an application for a contentious divorce. The issues taken into account to defend the client’s rights and interests are also explained below.
