La facultad de corrección: Una cuestión controvertida.

Abstract

[ES] El tema principal de este trabajo es el estudio jurídico de la patria potestad y de la facultad de corrección. Esta última siempre ha estado recogida en nuestra legislación y aceptada socialmente, pero tras su eliminación del Código Civil, surge la controversia social y jurídica sobre si determinadas conductas correctoras con fines educativos pueden constituir un delito de violencia familiar, o si este derecho no ha sido derogado por ser una función inherente al deber de los padres de educar a sus hijos.

[EN] The main subject of this assignment is the parental authority and the right of correction legal study. The latter has always been enshrined in our legislation and socially accepted. But after its repeal from the Spanish Civil Code, it poses the legal and social controversy about if given correction action for educational purposes may entail committing a domestic crime, or such right has not been eliminated because it may be part in the parental duty of education to their children as an inherent function.
