ESTUDIO JURÍDICO DE UN DELITO DE MALOS TRATOS HABITUALES Y POSTERIOR PROCEDIMIENTO DE DIVORCIO

Abstract

[ES] El presente estudio jurídico plantea el análisis de la comisión de un delito de maltrato psíquico habitual en el ámbito familiar, y un procedimiento de divorcio contencioso iniciado posteriormente. El dictamen responde a las diferentes cuestiones que se han planteado en torno al supuesto: en primer lugar se analizan el delito referido, la competencia jurisdiccional para conocer del mismo, y el cauce procesal por el que se tramita; continúa la investigación tratando los derechos que le son reconocidos a la perjudicada como víctima de un delito de violencia de género, realizándose seguidamente un estudio del procedimiento de divorcio contencioso a iniciar, exponiendo cómo se tramitaría y cuál es el órgano con competencia jurisdiccional al respecto; por último, se concluye con el estudio de las medidas sobre las que se pronunciaría la sentencia de divorcio.

[EN] The present legal study sets out the analysis of the commission of a habitual psychic abuse crime in the family sphere, and a contentious divorce procedure initiated afterwards. The document treats the different questions laid out about the assumption: firstly, the referred offense, the following jurisdictional competence, and the proceedings by which it is processed are analysed; the investigation continues treating the rights that are recognized to the harmed, as a victim of a crime of gender violence, followed by a study of the contested divorce process about to be initiated, explaining how it would be processed and what would be the court in this regard; finally, it is closed with the study of the actions on which the divorce sentence is pronounced.
