Resumen
[ES] El siguiente trabajo tiene como tema principal dentro de la Expropiación Forzosa, la ocupación temporal y sus características, donde se desarrollarán los sujetos que intervienen, se explicarán de forma meticulosa los diferentes tipos de ocupaciones temporales existentes actualmente, los cuales se rigen por la Ley de Expropiación Forzosa de 1954 y por el Decreto de 26 de abril de 1957, por el que se aprueba el Reglamento de la Ley de Expropiación Forzosa. También se exponen los diferentes procedimientos expropiatorios, que son: el ordinario y el de urgencia. Una vez realizado éste trámite veremos cómo se conceptúa y como se determina la cuantía económica indemnizatoria conocida como justiprecio. En ocasiones aparecen una serie de controversias como son la disputa para la fijación final del mismo entre el beneficiario y el expropiado o la demora en el pago. Para concluir se exponen varios casos reales sobre los daños producidos por situaciones de éste tipo.
[EN] The following work has as main theme within the Forced Expropriation, the temporary occupation and its characteristics, where the subjects involved will be developed, will be meticulously explained the different types of temporary occupations that currently exist, which are governed by the Law of Forced Expropriation of 1954 and by the Decree of April 26, 1957, which approves the Regulation of the Law of Compulsory Expropriation. The different expropriatory procedures are also presented, which are: the ordinary and the emergency. Once this process is done, we will see how it is conceptualized and how it is determined the economic indemnification amount known as fair price. Sometimes a series of controversies appear as the dispute for the final fixation of the same between the beneficiary and the expropriated or the delay in the payment. In conclusion, several real cases are exposed on the damages caused by situations of this type.
