LA DISOLUCIÓN DE LOS AYUNTAMIENTOS POR INCUMPLIMIENTO DE SUS OBLIGACIONES CONSTITUCIONALES EN MATERIA PRESUPUESTARIA

Resumen
[ES] Nuestro objetivo es el estudio de una institución protectora del orden constitucional: la
disolución de ayuntamientos. Aunque esta afirmación entrañe una paradoja, se trata de un
efecto solo aparente. La posibilidad de disolver un ayuntamiento compromete el principio
de autonomía municipal, pero una medida de tal entidad solo se adoptaría por graves
incumplimientos, como aquellos que afectan a la normativa presupuestaria y al principio
de estabilidad. Se comprende lo delicado del análisis, lo excepcional de su adopción, y las
garantías que el ordenamiento habrá de articular. Identificamos la figura en su regulación
actual, descubrimos su evolución histórica y los principios por los se rige y, por último, la
distinguiremos de figura que se nos antojan afines. El soporte normativo, además de la
Constitución, lo representarían la Ley de Bases de Régimen Local y la de Estabilidad
Presupuestaria. Por otra parte, como apreciamos que esta institución comparte naturaleza
con otras técnicas de protección del sistema constitucional, esbozamos el análisis del
artículo 155 CE.
[EN] Our goal is the study of a protective institution of constitutional order: the dissolution of city councils. Although this statement involves a paradox, it is only an apparent effect. The possibility of dissolving a city council compromises the principle of municipal autonomy, but such a measure would only be adopted for serious breaches, such as those affecting the budget regulations and the principle of stability. It is understand the delicate nature of the analysis, how the exceptional is its adoption, and the guarantees that the system will have to articulate. The figure will be identified in its current policy, its historical evolution and the principles governing the standardization, and finally, it will be distinguished figure that from other figures that may seem similar. The regulatory support, in addition to the Constitution, is represented by the Law of Local Government and budgetary stability. On the other hand, as this institution has a common nature other techniques to protect the Constitutional System, the analysis of the Article 155 CE will be outlined.
