Resumen
[ES] El atículo 47 de la Constitución Española de 1978 consagra el
derecho de todos los españoles a disfrutar de una vivienda digna y
adecuada, así como que los poderes públicos promoverán las
condiciones necesarias y establecerán las nom1as pertinentes para
hacer efectivo este derecho.Sin embargo, existen grandes
dificultades para conseguir este derecho.
Si bien son existen dos vías generales para lograr una vivienda
digna y adecuada: el acceso a la propiedad o el alquiler, sólo nos
referimos en este trabajo a la primera y concretándola en las
ventas o compraventas entre empresarios y consumidores.
En el trabajo analizamos la protección jurídica del consumidor
adquirente de vivienda tanto en la fase precontractual, como en la
contractual e incluso, a la fase posterior.
Es destacable la existencia de abundante legislación, desconocida
por el consumidor, y poco aplicada por la Administración, lo que
ha propiciado fraudes y estafas a los consumidores
