El presente trabajo de fin de grado trata sobre la suspensión de la ejecución de la pena privativa de libertad.
La reforma introducida por la Ley Orgánica 1/2015, de 30 de marzo, introduce cambios importantes. Por un lado, se modifica el régimen relativo a la suspensión, quedando estructurada en un único modelo que engloba todas las medidas alternativas a la prisión: suspensión, libertad condicional y sustitución. Quedando organizadas de la siguiente manera: suspensión sin estancia en prisión y con estancia en prisión. Y, a su vez, establece distintos modelos extraordinarios. Por otro lado, estas medidas alternativas se fundamentan en la prevención especial que tiene como finalidad la reinserción del delincuente.
Para la concesión de la suspensión es necesaria la concurrencia de una serie de presupuestos que serán desarrollados.
[EN] This present end-of-degree work is about the suspension of the execution of custodial sentence. The reform introduced by the Organic Law 1/2015, of March 30th, introduces important changes. On the one hand, the suspension regime is modified, being structured into a single model that encompasses all alternative measures to prison: suspension, parole and substitution. These measures are organized in the following way: suspension without staying in prison and suspension with staying in prison. And, in the same way, it establishes different extraordinary models. On the other hand, these alternative measures are based on special prevention whose purpose is the reintegration of the offender. For the concession of the suspension it is necessary the concurrence of a series of budgets which will be developed.
