LOS EFECTOS PERSONALES Y PATRIMONIALES EN LAS CRISIS MATRIMONIALES: ESPECIAL REFERENCIA A LA PENSIÓN COMPENSATORIA Y A LA CUSTODIA COMPARTIDA

Abstract

[ES]El trabajo está enfocado en el estudio de las crisis matrimoniales concretamente en el desarrollo de los efectos personales y patrimoniales que derivan de ellas. Para ello parto de la base de la regulación actual y de las últimas reformas plasmadas en la ley 15/2015 de 2 julio de jurisdicción voluntaria. En el mismo desarrollaré los medios para llevar a cabo la separación o divorcio, ya sea por convenio regulador o por vía judicial, así como las medidas que establecen ambos. El trabajo destaca, sobre todo, los aspectos relacionados con los hijos como la atribución de la guarda y custodia y la pensión compensatoria, así como la atribución del uso la vivienda y la pensión de alimentos en caso de separación o divorcio

[EN]This end-of-degree dissertation is focused on the study of marital crisis, and more specifically, on the development of the personal and patrimonial effects. It starts from the current regulation and the latest reforms of the law 15/2015 2th July of voluntary jurisdiction. In this dissertation, it’s going to be developed the means to proceed the separation or divorce, by regulation, agreement or judicial procedure, as well as the measures that are established. The dissertation stands out, especially, the aspects of children in terms of the attribution of shared custody and compensatory pension, as well as the attribution of the use of the household and child support in the cases of separation and divorce.
