Telecomunicaciones y municipios: regulación y problemática judicial

Abstract

[ES]El presente trabajo trata de ofrecer una visión general sobre la situación actual del sector de las telecomunicaciones en cuanto a su regulación por los entes locales así como la jurisprudencia del Tribunal Supremo en el referido ámbito. En un primer momento, y como forma de contextualizar el tema, definiremos que son las telecomunicaciones así como la consideración que las mismas han tenido a lo largo de su historia. Posteriormente, y también desde una perspectiva dinámica, señalaremos cuál es la regulación actual de las mismas, tanto desde el punto de vista estatal, como desde el comunitario, siendo conscientes que ha sido éste último el que ha impulsado el cambio experimentado a nivel interno. Finalmente, afrontaremos el análisis del papel que los municipios tienen en la regulación de las telecomunicaciones así como la problemática judicial asociada a esta intervención local.

[EN]The present work tries to offer a general overview about the current situation of judicial control of municipal ordinances on telecommunications. At the first moment, and as a way of contextualizing the topic, we will define what telecommunications are as well as the consideration they have had throught their history.Afterwards, and also from a dinamic perspective, we will point out which is the current regulation of those telecommunications, from the state point of view as from the community one. We are aware that the latter has been the impeller. Finally, we will discuss the role that town councils have in telecommunication regulation as well as judicial problems associated to this local intervention.
