COMUNIDAD HEREDITARIA

Abstract

[ES]La finalidad de este trabajo es contemplar desde un punto de vista doctrinal, jurisprudencial y crítico la problemática relacionada con la comunidad hereditaria, partiendo de la base de su regulación en el Código Civil. Se destacan las características de la propia comunidad como forma de cotitularidad que comienza con la aceptación de una herencia y finaliza, como causa típica con la partición, aunque hay otras muchas más causas de extinción, que convierten a la comunidad en una situación con carácter transitorio y especial, ya que no se constituye de una manera permanente de gestión del caudal comunitario, sino con la idea de preservar de la mejor manera posible los bienes de la misma, para en un momento posterior llevar a cabo su liquidación de la forma más beneficiosa para los miembros de dicha comunidad.

[EN]The aim of this work is to contemplate from a doctrinal, jurisprudential and critical point of view the problematic related to the hereditary community, starting from the base of its regulation in the Civil Code. The characteristics of the community itself are outlined as a form of co-ownership that begins with the acceptance of an inheritance and ends, as a typical cause with the partition, although there are many other causes of extinction, which makes the community a temporary and special situation, since it does not constitute a permanent way of managing the community flow, but with the idea of preserving the best possible of the property of the same, to at a later moment carry out its liquidation in the most beneficial for the members of that community.
