La Capacidad de Obrar del Menor y su Repercusión en el Derecho de Daños.

Abstract

[ES]Este trabajo se centra en los actos ilícitos cometidos por los menores, y cómo se han de estudiar y de tratar, ya que éstos a pesar de no tener una capacidad de obrar plena, cuentan con autonomía social y jurídica bastante importante que a veces puede suponer un problema como sujetos que actúan libremente y como sujetos responsables de sus actuaciones. Ante esto, nuestros Tribunales establecen una responsabilidad objetiva hacia los padres por los daños que hayan cometido sus hijos, ya que estos son insolventes, por lo que deberán responder de forma solidaria ya que hay que indemnizar y proteger a la víctima o víctimas que hayan sufrido el daño causado por el menor.

[EN]This project focuses on unlawful acts committed by minors, and how they should be studied and dealt with, as they don’t have the capacity to act fully, they have considerable social autonomy, and it can sometimes be a problem, as subjects that act freely and as subjects responsible for their actions. Faced with this, our Courts establish an objective liability to parents for the damages that their children have committed, since they are insolvent, so they must respond in a joint way as it is necessary to compensate and protect the victim or victims who have suffered the damage caused by the minor.
