LOS DERECHOS SUCESORIOS DEL CÓNYUGE VIUDO.

Abstract

[ES]Este trabajo versa sobre la regulación que el ordenamiento jurídico español ofrece en relación al cónyuge viudo en materia sucesoria; por ello se hará un recorrido por su situación jurídica, comenzando por su posición como legitimario de la herencia de su cónyuge; tratando la posible atribución de un usufructo universal a través de la Cautela Socini; las causas que pueden afectarle en materia de desheredación cuáles son los derechos sucesorios que le corresponderán en la herencia intestada del causante.

[EN]This work covers the treatment of the Spanish legal system to the widowed spouse for purposes of inheritance, so it’s an analysis about each of the positions for each case in the law, both doctrine and jurisprudence in each one of the legal assumptions, thus also offering some of my conclusions and reasonings. It’s going to start explaining what constitutes the legitimate spouse of the widow, ending the causes of disinheritance provided for in the Spanish Civil Code. So it is interesting to analyze this subject of law in which we find a different treatment by the civil rules as we can see in this work.
