EL ACCESO AL REGISTRO CIVIL DE LA GESTACIÓN POR SUSTITUCIÓN.

Abstract

[ES]La gestación por sustitución, aúna complejos caracteres que es necesario analizar y, como en todas las materias donde el Derecho confluye con la ética, el debate se torna complejo.

Siendo un tema presente en la sociedad actual es necesario analizar pormenorizadamente las normas y la Jurisprudencia. La admisión de esta técnica en nuestro ordenamiento, a la vez que supondría una evolución importante y paralela a los avances de la técnica, dividiría la sociedad porque tal técnica no cuenta con el beneplácito general.

El presente trabajo aborda la materia desde la perspectiva de los Derechos Humanos, de los derechos fundamentales de la madre gestante y del menor nacido fruto de la gestación por sustitución, y de las normas civiles, registrales y de Derecho Internacional Privado.

Así, en este trabajo pretendo hacer un recorrido completo que ponga de manifiesto tanto la problemática legal como práctica que presenta la gestación por sustitución.

[EN]The subject of this essay, surrogacy, brings together several facts that we consider important enough to study to create a reasoned view. This issue also happens in the rest of practice areas where Law meet Ethics so the debate becomes complex.

Our essay approaches this subject according to Human Rights, surrogate mother and child’s rights, but, also, according to International Private Law regulation. International Standards review this subject but there is not enough precedent to find a final solution to this legal problem.

Legalized surrogacy will be a big boost for this area and it will allow scientist to make breakthroughs in this discipline. Nevertheless, this legalization will create divisions in society because it does not have its consent.

Thus, we believe a deep analyze of the rules and Common Law needs to be done, since this topic continues to remain an unsolved question.
