El medio ambiente como materia imponible

Abstract

[ES]La protección del medio ambiente en sede constitucional, fue una de las innovaciones normativas del constituyente español. Quien incluyó, entre los principios rectores de la política social y económica, el derecho a disfrutar de un medio ambiente adecuado. Vinculando el medio ambiente con la calidad de vida, el desarrollo personal y la propia dignidad individual, como ha reconocido el propio Tribunal Constitucional. Corresponde a los poderes públicos, singularmente al legislativo, articular los instrumentos necesarios para la preservación del medio natural. El tributo, sería uno de esos medios, instrumentalizándolo a través de la denominada función extrafiscal. A las formas de utilización del tributo con finalidad medioambiental, dedicamos nuestro estudio.

[EN]The protection of the environment at constitutional headquarters was one of the normative innovations of the Spanish constituent. Who included, among the guiding principles of social and economic policy, the right to enjoy an adequate environment. Linking the environment with quality of life, personal development and individual dignity, as recognized by the Constitutional Court itself. It corresponds to the public powers, singularly to the legislative, to articulate the necessary instruments for the preservation of the natural environment. The tribute, would be one of those means, instrumentalizing it through the so-called extra-fiscal function. To the forms of use of the tribute with environmental purpose, we dedicate our study.
