El papel del Rey en la investidura del Presidente del Gobierno en España regulado en el art. 99 de la CE no había sido puesto en cuestión durante los últimos treinta y ocho años de democracia. Sin embargo en la XI legislatura y como consecuencia de un nuevo escenario de fragmentación de los partidos politos tradicionales y la emergencia con fuerza de otros nuevos, no se consiguieron las mayorías necesarias para formar gobierno. En este nuevo escenario, emergieron las debilidades de una regulación constitucional que en tales circunstancias, hasta entonces inéditas en nuestro país, colocaban al Rey en una difícil situación.
[EN] The King’s role in the First Minister’s investiture regulated by the article 99 of our Spanish Constitution, hasn’t been called into question during the last thirty-eight years of democracy. However, in the eleventh term and as a consequence of a new stage (traditional political party’s fragmentation and the new ones), didn’t achieve enough votes which gave them the opportunity to make government. So, in this new stage, some debilities appeared in a constitutional regulation; up to them new positions put our King in a difficult situation.
