Resumen
El presente trabajo se centra en analizar la Renta Básica como derecho social, conceptualizándolo dentro del marco del ordenamiento jurídico español, exponiendo argumentos a favor y en contra en un contexto de crisis económica, donde la desigualdad, pobreza y precariedad laboral han ido incrementando; tratando de darle sentido a este derecho social propio de la democracia, y que se ve vinculado a las condiciones presupuestarias.
El Derecho a una Renta Básica aunque no esté regulado de manera expresa en la Constitución Española, son los Estatutos de Autonomía de cada Comunidad Autónoma los que lo “dotan” de regulación.
This paper focuses on analyzing the basic income as a social right, conceptualized within the framework of the Spanish legal system, exposing arguments for and against a background of economic crisis, where inequality, poverty and job insecurity have been increasing; trying to make sense of the right to own social democracy, and which is linked to budgetary conditions. The rights to a Basic Income even if not expressly regulated in the Spanish Constitution, are the Statutes of Autonomy of each Autonomous Community that it "endows" regulation.
