La responsabilidad civil de los centros docentes públicos y privados

Abstract

[ES] El objeto de este trabajo será el estudio de la responsabilidad civil del personal docente, así como de los titulares de los centros docentes, por los daños sufridos o causados por sus alumnos menores de edad, durante el tiempo que están bajo su custodia. Asimismo, indagaré en si la falta de diligencia del profesor, así como la edad del menor, son los criterios de justicia principales para pedir responsabilidad. He tomado como guía los artículos 1902 y 1903 del Código Civil, así como la Ley 30/1992, de 26 de noviembre, (LRJ-PAC). Para ello he desarrollado tres partes: en la pnmera acometo, como cuestión previa, una evolución histórica de la responsabilidad civil de la Administración pública; en la segunda comparo la normativa aplicable a los centros privados y públicos, y en la tercera desarrollo un análisis jurisprudencial de casos similares con responsabilidades distintas según ocurran en centros docentes privados o públicos.

[EN] The object of this work is the study of the civil liability of teachers, as well as holders of educational institutions, for the damages suffered or caused by underage students, during the time that are in their custody. Also, I will study on whether the lack of diligence of the teacher, as well as the age of the minor, are the main criteria of justice to ask for responsibility. I have taken as a guide the articles 1902 and 1903 of the Civil Code, as well as the Law 30/1992, of 26 November, (LRJ­ PAC). So, I have developed three parts: in the first, I do, as a previous question, a historical evolution of the civil liability of the public administration; in the second, I compare the regulations applicable to private and public educational institutions; and in the third, I have done a iurisprudential analysis of similar cases with different responsibilities according to the educational institution's type, public or private.
