DERECHO DE REPETICIÓN

Abstract

[ES] Éste trabajo supone un estudio acerca del Derecho de Repetición en el ámbito de los seguros de vehículos a motor y su incidencia en los asegurados. De igual modo, se trata la prescripción a la que hace referencia el artículo 10 de la LRCSCVM y la aparición de posibles cláusulas limitativas de los derechos de los asegurados en la contratación de seguros voluntarios, así como el tratamiento que le da a ésta cuestión la doctrina y la jurisprudencia. Se realiza también la contestación a una demanda interpuesta por una aseguradora que pretende el ejercicio del derecho de repetición contra su asegurado.

[EN] This work is a study on the Law of Repetition in the field of motor vehicles insurance and its impact on policyholders. Similarly, it is about the prescription which is referred to the article ten of the LRCSCVM and the appearance of possible limitative clauses of rights of the policyholders in the voluntary insurance engagements, as well as the treatment which is given to it by the doctrine and the jurisprudence. It also performs the answer to a lodged request which hopes the practice of the Law of Repetition.
