UNA REFORMA ESPERADA:UNA REFORMA ¿ENTENDIDA? EL TRABAJO SOCIAL COMO ESLABÓN SOCIAL

Abstract

El Trabajo Fin de Grado que se presenta analiza desde y para el Trabajo Social los cambios incorporados por la Ley 8/2021 de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica adecuando nuestro ordenamiento jurídico a lo establecido en el artículo 12 de la Convención Internacional sobre los Derechos de las Personas con Discapacidad. El desarrollo legislativo a lo largo de los años ha supuesto un cambio en el modelo de tratamiento de la discapacidad y culmina con el respeto a la dignidad de la persona, en la tutela de sus derechos fundamentales y en el respeto a la libre voluntad de la persona con discapacidad, así como en los principios de necesidad y proporcionalidad de las medidas de apoyo. The Final Degree Project that is presented analyzes from and for Social Work the changes incorporated by Law 8/2021 of June 2, which reforms the civil and procedural legislation to support people with disabilities in the exercise of their legal capacity, adapting our legal system to the provisions of Article 12 of the International Convention on the Rights of Persons with Disabilities. The legislative development over the years has led to a change in the model of treatment of disability and culminates in respect for the dignity of the person, in the protection of their fundamental rights and respect for the free will of the person with disabilities, as well as in the principles of necessity and proportionality of support measures. This new model cannot be alien to Social Work
