UNA REFORMA ESPERADA:UNA REFORMA ¿ENTENDIDA? EL TRABAJO SOCIAL COMO ESLABÓN SOCIAL

Abstract

El Trabajo Fin de Grado que se presenta analiza desde y para el Trabajo Social los cambios incorporados por la Ley 8/2021 de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica adecuando nuestro ordenamiento jurídico a lo establecido en el artículo 12 de la Convención Internacional sobre los Derechos de las Personas con Discapacidad. El desarrollo legislativo a lo largo de los años ha supuesto un cambio en el modelo de tratamiento de la discapacidad y culmina con el respeto a la dignidad de la persona, en la tutela de sus derechos fundamentales y en el respeto a la libre voluntad de la persona con discapacidad, así como en los principios de necesidad y proporcionalidad de las medidas de apoyo.
