Explorando la adopción abierta desde una perspectiva de Trabajo Social

Abstract

Actualmente, la adopción crea una relación de filiación entre adoptante/s y adoptado desplegando los mismos efectos que si fuera un hijo/a biológico. Con carácter general, la adopción extingue los vínculos jurídicos entre el adoptado y su familia de origen. No obstante, la Ley 26/2015, de 28 de julio, de modificación del sistema de protección a la infancia y a la adolescencia incluyó el apartado 4 del art. 178.4 del Código civil, permitiendo la denominada adopción abierta y, por tanto, el mantenimiento de la relación con la familia de origen en los términos que establezca la autoridad judicial al constituir la adopción. La intervención del Trabajo social constituye una pieza fundamental en el procedimiento de adopción y posiblemente, más aún, en la adopción abierta como justifica el trabajo

Currently, adoption creates a relationship of filiation between the adopter/s and the adoptee, displaying the same effects as if it were a biological child. In general, adoption extinguishes the legal ties between the adoptee and his or her family of origin. However, Law 26/2015, of July 28, modifying the system of protection for children and adolescents included section 4 of art. 178.4 of the Civil Code, allowing the so-called open adoption and, therefore, the maintenance of the relationship with the family of origin in the terms established by the judicial authority when constituting the adoption. The intervention of Social Work constitutes a fundamental piece in the adoption procedure and possibly, even more so, in open adoption asjustified by the work
