Posición del Consejo de Europa ante el Terrorismo.

Abstract

El presente trabajo aborda las medidas que el Consejo de Europa adopta en materia de terrorismo teniendo en cuenta la protección de los Derechos Fundamentales en este ámbito. A través de un estudio previo de la Organización Internacional, de las garantías que nos ofrece el reconocimiento de los Derechos Fundamentales, así como de lo que el terrorismo supone respecto de ellos, se deduce la importancia que tiene respetar dichos Derechos Fundamentales en la persecución, prevención y respuesta a los actos terroristas (considerados como delictivos). Para ello, son los Estados por medio de los poderes públicos los que deben garantizar la no vulneración de estos derechos que por su condición van unidos a la dignidad humana y que por lo tanto son inalienables, inviolables e irrenunciables.

The current Degree’s Final Project addresses the measures adopted by the Council of Europe in relation with terrorism, considering the protection of Fundamental Rights. This Project draws from an analysis of the International Organisation, together with the guarantees offered by the recognition of Fundamental Rights, as well as of what terrorism implies regarding them, so as to confirm the importance of respecting these Fundamental Rights in the persecution, prevention and response to terrorist acts (considered criminal). To achieve this goal, and by means of public authorities, the Governments must guarantee the non-infringement of these rights, which due to their condition, they are linked to human dignity which means that they are inalienable and inviolable.
