LOS PACTOS PREMATRIMONIALES EN PREVISIÓN DE RUPTURA EN NUESTRO ORDENAMIENTO JURÍDICO

Abstract

El presente trabajo tiene por objeto el estudio de la novedosa figura de los acuerdos o pactos prematrimoniales en previsión de ruptura. En nuestro país se ha producido una creciente expansión de este tipo de acuerdos en cuya virtud quienes tienen previsto contraer matrimonio con vistas a su celebración, establecen cómo van a desenvolverse sus relaciones o las consecuencias personales y patrimoniales ante una posible ruptura conyugal. Se determinará la regulación en el Derecho común, y en el Derecho catalán así como el alcance y límites a la autonomía de la voluntad además de los criterios seguidos por la jurisprudencia del Tribunal Supremo en torno a su admisibilidad y validez. The purpose of this work is to study the novel figure of premarital agreements or covenants in anticipation of rupture. In our country there has been a growing expansion of these legal instruments by virtue of which those who plan to marry with a view to its celebration, establish how their relationships or the personal and patrimonial consequences will unfold in the event of a possible marital breakdown. The regulation in Civil Law, as well Catalan Law, and the scope and limits to the autonomy of the will be determined in addition as the criteria followed by the jurisprudence of the Supreme Court regarding its admissibility and validity.
