CONFLICTO EN LA HERENCIA. CONDOMINIO

Abstract

El presente Trabajo de Fin de Grado, tiene como principal objetivo analizar los numerosos pasos que tienen que llevar a cabo los herederos para repartirse una herencia conflictiva. Tras el fallecimiento del causante y hasta que los herederos aceptan la herencia, el patrimonio del fallecido se encuentra en lo que se denomina herencia yacente. En el momento que los herederos la aceptan, estos ocupan la posición jurídica del causante y por tanto la posesión de todos sus bienes muebles e inmuebles. El TFG ha sido desglosado en cuatro capítulos, siendo de especial importancia los trámites administrativos que tienen que llevar a cabo los herederos del causante. En concreto, tanto la obtención del certificado de defunción como el de actos de última voluntad. Además, se hace mención a la legítima, a la aceptación de la herencia y disconformidad entre los herederos, soluciones que se pueden plantear, así como, una breve referencia al condominio. The main purpose of this Final Degree Project is to analyze the numerous steps that the heirs have to carry out in order to distribute a conflicting inheritance. After the deceased's death and until the heirs accept the inheritance, the deceased person's estate is in what is called a lying inheritance. When the heirs accept it, they occupy the legal position of the deceased and therefore the possession of all their personal and real property. The TFG has been broken down into four chapters, the administrative procedures that the heirs of the deceased have to carry out are of special importance. Specifically, both obtaining the death certificate and acts of last will. In addition, mention is made of the legitimate one, the acceptance of the inheritance and disagreement between the heirs, solutions that can be considered, as well as a brief reference to the condominium.
