La legítima del cónyuge viudo.

Abstract

Uno de los principales objetivos de este trabajo de investigación es realizar un estudio detallado de la legítima del cónyuge viudo. Esta legítima ha sido modificada a lo largo de los años hasta su actual regulación en el Código Civil. Se pretende clarificar algunas ideas fundamentales sobre el derecho que tiene el cónyuge supérstite cuando su consorte fallece, así como la concurrencia de este y los herederos a la herencia. Además, veremos las singularidades y mejoras que tiene esta figura dentro del testamento de forma exhaustiva. De igual modo, estudiaremos los derechos sucesorios del cónyuge viudo en la separación civil de hecho y la separación canónica, debido a sus importantes efectos. Finalmente, analizaremos la cuestión de la reserva vidual, una figura relevante dentro del testamento por las particularidades que presenta. One of the objectives of this research work is carry out a detailed study of the legitimate of the widowed spouse. This legitimate has been modified throughout the years until its current regulation in the Civil Code. The intention is to clarify some fundamental ideas about survivor spouse’s right when its consort die, as well as the concurrency of this one and the heirs to inheritance. In addition, we’ll be aware of the singularities and improvements that this figure has inside the testament exhaustively. In the same way, we’ll study the succession rights of the widowed spouse in the effective civil separation and the canonical separation, due to its important effects. Finally, we’ll analyze the question of the widowed reserve, a relevant figure inside the testament for the particularities it presents.
