Participación de la herencia

Abstract

[ES] Este trabajo va a trata de analizar y explicar la participación de la herencia, haciendo referencia a todas sus modalidades, facultades y clases pero centrándonos más en el tema de la participación de la herencia practicada por el propio testador junto con la participación de la herencia llevada a cabo por el contador partidor. También vamos a tratar el tema del contador partidor-dativo y los cambios ocasionados en el mismo. Junto a todo esto, se incluirán las interpretaciones y opiniones tanto de la doctrina y la jurisprudencia como de relevantes autores con respecto a problemas que puede plantear la partición de la herencia. Por último lugar, vamos a hacer referencia a una variada jurisprudencia mostrando las soluciones ante las diferentes problemáticas surgidas.

[EN] This work will try to analyze and explain the partition of the inheritance, making reference to all its modalities, faculties and classes but focusing more on the issue of the inheritance partition practiced by the testador himself along with the partition inheritance carried performed by the splitter counter. We are also going to deal with the subject of the dash-dative counter and the changez caused in it. Along with all this, interpretations and opinions of both the doctrine and jurisprudence and relevant authors will be included with respect to problems that may arise from the partition of the inheritance. Finally, we will refer to a varied jurisprudence showing the solutions to the different problems that have arisen.
