Matrimonios de Conveniencia

Abstract

[ES] El trabajo se centra en los denominados matrimonios de conveniencia, enfocándose principalmente en el problema que presentan y en las consecuencias que derivan de los mismos. Se introduce una descripción de lo que representa la institución del matrimonio, basada en varios autores y por supuesto refrendada con lo que dicta el Código Civil y la Constitución Española. En el presente trabajo también se habla sobre la actualidad de estos matrimonios fraudulentos y sobre las medidas existentes para frenar este fenómeno, así como sobre los requisitos que han de cumplir para que un matrimonio sea declarado fraudulento o no, con especial atención al consentimiento. Del mismo modo se hace referencia al procedimiento necesario para la inscripción del matrimonio en el registro civil, y por último se habla sobre las modificaciones en la normativa y los mecanismos de control de los cuales disponen las instituciones públicas españolas.

[EN] The work focuses on so-called marriages of convenience, focusing mainly on the problem they present and the consequences that derive from them. A description of what the institution of marriage represents, based on several authors and of course endorsed with what dictates the Civil Code and the Spanish Constitution is introduced. This paper also discusses the actuality of these fraudulent marriages and the existing measures to curb this phenomenon, as well as the requirements that must be met for a marriage to be declared fraudulent or not, with special attention to consent. In the same way reference is made to the procedure necessary for the registration of marriage in the civil registry, and lastly, there is talk about the changes in the regulations and the control mechanisms available to Spanish public institutions.
