LEGÍTIMA DEL CÓNYUGE VIUDO. ASPECTOS LEGALES

Abstract

[ES] El objeto de este trabajo consiste en llevar cabo un estudio detallado de la regulación de la legítima del cónyuge viudo en el Código Civil, y un análisis de esta institución tanto en los textos legales como en las grandes controversias encontradas en la jurisprudencia. Para ello, realizaremos un análisis de la naturaleza jurídica y de los presupuestos de la legítima del cónyuge viudo y su regulación actual. Destacamos las grandes particularidades que presenta la legítima del cónyuge supérstite en nuestra regulación y las facultades o derechos que se le asignan a este legitimario cuando su cónyuge fallece. Asimismo, hablamos de las garantías de las que goza el cónyuge viudo frente al resto de herederos. Brevemente hacemos referencia a las distintas instituciones que tienen relación con la legítima como la desheredación o conmutación y a la situación que ocupa dicho cónyuge, con respecto, al resto de legitimarios en la herencia.[EN] The object of this project is to carry out a detailed study of the regulation of the widowed spouse in the Civil Code and an analysis of this institution has both in the legal texts and in the major controversies found in the jurisprudence. To do this, we will carry out an analysis of the legal nature and budgets of the legitimate widowed spouse and its current regulation.

For all this, we highlight the great particularities of the legitimacy of the surviving spouse in our regulation and the faculties or rights that are assigned to this heir when his or her spouse dies. Likewise, we talk about the guarantees that the widowed spouse enjoys compared to the rest of the heirs. Briefly, we refer to the different institutions that have in relation to the legitimate one such as disinheritance or commutation and to the situation that said spouse occupies, with respect, to the rest of heirs of the inheritance.
