LA DESHEREDACIÓN DE LOS DESCENDIENTES: EL MALTRATO PSICOLÓGICO Y EL ABANDONO DE LOS PADRES POR LOS HIJOS COMO MODALIDAD DEL MALTRATO DE OBRA

Abstract

[ES] El presente trabajo aborda la realización de un análisis y exposición de la institución de la desheredación. Para ello, se pondrá en relación con otras figuras propias del Derecho de Sucesiones, así como se atenderá al cambio en la orientación jurisprudencial adoptado por los tribunales acerca de las causas que provocan la privación de la legítima, contemplando los diferentes fenómenos sociales que pueden ser causantes de tal modificación. Siendo la legítima uno de los temas más discutidos dentro del mundo jurídico y social, por el límite que supone con respecto a la libertad del testador, cabe plantearse si el sistema presentado por el Código Civil en relación con la misma, es adecuado y se adapta a las exigencias actuales o, por el contrario, es merecedor de un cambio.

[EN] This project approaches the analysis of the institution of disinheritance. In order to do that, it will be studied in relation with other figures that belong to the inheritance rights sector and also considering the change in the jurisprudencial criteria when applying the causes that prevent the heirs from receiving the rightful part of the inheritance. For that purpose, social changes will be taken into account as factors. The rightful inheritance that is due to some relatives is one of the most controversial matters in the law and social community, as it limits the freedom of the testator when deciding how to part his goods. Therefore it is essential to analyse if the system presented by the actual law code is right or on the contrary, it is necessary to introduce a change.
