ANÁLISIS DE LA REFORMA DE LA LEY DE ORDENACIÓN DEL COMERCIO MINORISTA. SENTENCIA Nº C-295/16 DEL TRIBUNAL EUROPEO DE JUSTICIA, 19 DE OCTUBRE DE 2017.

Abstract

[ES] El presente Trabajo Fin de Grado se enmarca dentro del estudio de las distintas leyes que regulan la venta bajo precio de adquisición, como son la Ley de Ordenación del Comercio Minorista en su artículo 14 y la Ley de Competencia Desleal en su artículo 17. Se analizará el contenido de la Sentencia del Tribunal de Justicia de la Unión Europea por la que España ha sido obligada a modificar el contenido del precepto 14 de la Ley de Ordenación del Comercio Minorista, al ir este artículo en contra de lo recogido en la Directiva 2005/29/CE del Parlamento Europeo y del Consejo de 11 de mayo de 2005 relativa a las prácticas comerciales desleales de las empresas en sus relaciones con los consumidores en el mercado interior.

[EN] This final year project forms part of a study of different acts that regulate the low-price sales, such as the Act on Retail Commerce, in its Article 14, and Unfair Competition Act, in its Article 17. I would draw your attention to the judgment handed down by the Court of Justice of the European Union (ECJ) for which Spain has been obliged to modify the wording of the Article 14 of the Act on Retail Commerce, as this article went against what was gathered in the Directive 2005/29/EC of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market.
