Evolución de la legislación penal franquista (1936-1944)

Abstract

El presente trabajo tiene como fin establecer una síntesis expositiva de cómo se desarrolló y produjo las herramientas represivas del régimen franquista con especial hincapié en el uso del derecho penal de autor (derecho del enemigo). Para ello se analizarán los tribunales militares, los procesos de depuración, la Ley de Responsabilidades Políticas, la Ley de Masonería y Comunismo, la Ley de Seguridad del Estado y los procedimientos e instituciones que se configuraron para hacer efectivas sus ejecuciones.

The purpose of this work is to establish an expository synthesis of how the repressive tools of the Franco regime were developed and produced with special emphasis on the use of criminal law of the enemy.For this, the military courts, the purification processes, the Law of Political Responsibilities, the Law of Masonry and Communism, the Law of State Security and the procedures and institutions that were configured to make their executions effective are analyzed.
