Resumen
[ES] El alquiler de vivienda es una alternativa a la propiedad cada vez más
frecuentada en una situación de crisis económica como la actual. Como consecuencia
del incremento del número de inquilinos y debido a dicha crisis, también aumenta el
número de impagos de las rentas debidas.
En ocasiones, el arrendatario ha estado más protegido legalmente que el
arrendador, resultando otras veces al contrario. Estas situaciones han producido
desequilibrios de intereses que seguidamente han motivado diversas reformas, las cuales
buscan más seguridad y confianza entre las partes así como una mayor agilización
procesal. En el presente Trabajo de Fin de Grado, se recoge como base el Derecho
sustantivo y se profundiza en el Derecho procesal como vía de solución de los
conflictos, concretamente en el juicio de desahucio por falta de pago del alquiler, un
proceso sumario destinado al pago de las cantidades debidas del arrendatario y al
restablecimiento de la posesión de la finca urbana del arrendador
[EN] The rental housing is an alternative to the increasingly crowded in a situation of economic crisis like the current property. As a result of the increase in the number of tenants and because of the crisis, it also increases the number of defaults of pensions due. Sometimes, the tenant has been more protected legally the landlord, resulting sometimes in contrast. These situations have produced imbalances interests that have subsequently led several reforms, which seek more security and confidence between the parties and greater procedural streamlining. Working in this Final Project is collected based on the substantive law and procedural law deepens as a means of resolving conflicts, particularly in the judgment of eviction for nonpayment of rent, a summary proceeding for the payment the amounts due from the lessee and the restoration of possession of urban property of the lessor.
