Resumen
[ES]El objetivo principal de este trabajo es realizar un estudio sobre la sustracción internacional de menores desde la perspectiva del Derecho Internacional Privado español. La regulación de esta materia presenta la particularidad de contenerse en normas procedentes de diversas fuentes de origen convencional, institucional y autónomo; ante la existencia de este entramado normativo, el operador jurídico deberá garantizar el interés superior del menor en aquellos casos en los que se produzca un traslado ilícito. Para la consecución de este objetivo, se ha llevado a cabo un estudio de la reglamentación existente, así como un análisis jurisprudencial acerca de los puntos más controvertidos. De esta manera, se ha podido verificar como la sustracción internacional de menores presenta determinadas fortalezas y debilidades en referencia a su régimen normativo.
[EN]The main objective of this work is to carry out a study on the international abduction of minors from the perspective of Spanish Private International Law. The regulation of this subject presents the peculiarity of being contained in norms coming from diverse sources of conventional, institutional and autonomous origin; In view of the existence of this normative framework, the legal operator must guarantee the best interests of the child in cases in which an illegal transfer occurs. In order to achieve this objective, a study of the existing regulations has been carried out, as well as a jurisprudential analysis of the most controversial points. In this way, it has been possible to verify how the international abduction of minors presents certain strengths and weaknesses in reference to its normative regime.
