Resumen
[ES] El Derecho concursal internacional ha sido un tema que se ha tratado durante muchos años y especialmente desde la entrada en vigor del primer Reglamento Europeo 1346/2000. La falta de normas específicas españolas diseñadas para solucionar los problemas relacionados con problemas internacionales en el ámbito internacional hizo que el panorama cambiara con la aprobación de la Ley Concursal Española 22/2003, considerada complementaria con el anterior Reglamento Europeo. Pero existían algunas lagunas en estas normativas, las cuales no fueron solucionadas hasta la entrada en vigor del nuevo Reglamento (UE) 2015/848 sobre procedimientos de insolvencia, el cual introduce modificaciones significativas en el anterior Reglamento, especialmente en materia de competencia judicial internacional y en procedimientos secundarios y la coordinación entre procedimientos.
[EN] International bankruptcy law has been a subject of discussion for many years and especially since the entry into force of the first European Regulation 1346/2000. The lack of specific Spanish rules designed to solve the problems related to international problems in the international sphere caused the panorama to change with the approval of the Spanish Bankruptcy Law 22/2003, considered complementary to the previous European Regulation. But there were some gaps in these rules, which were not resolved until the entry into force of the new Regulation (EU) 2015/848 on insolvency proceedings, which introduces significant amendments to the previous Regulation, especially in the area of international jurisdiction and in secondary proceedings and coordination between proceedings.
