Resumen
[ES]Este trabajo tiene por objeto analizar la medida del internamiento involuntario por razón de trastorno psíquico. Para poder realizar dicho análisis visualizamos la evolución de la normativa que lo regula hasta llegar a la vigente hoy en día, que es el artículo 763 de la Ley de Enjuiciamiento Civil.
Después continuamos examinando todo el procedimiento de esta medida, en la que se contempla, gracias a una previa autorización del juez, la posibilidad de realizar el internamiento involuntario de enfermos mentales con el fin de poder aplicarles un tratamiento psiquiátrico, en beneficio no solo del paciente sino de la sociedad, debido a la peligrosidad social que pudiera ocasionar el enfermo.
Y por último, también estudiamos el caso del internamiento involuntario psiquiátrico por razón de urgencia, así como los internamientos involuntarios en centros geriátricos o sociosanitarios.
[EN]This work aims to analyze the measure of involuntary internment by reason of psychic disorder. In order to carry out this analysis, we visualize the evolution of the regulations that regulate it up to the current one, which is Article 763 of the Civil Prosecution Law. Then we continue to examine the entire procedure of this measure, which contemplates, thanks to a previous authorization from the judge, the possibility of involuntary hospitalization of mental patients in order to be able to apply psychiatric treatment, in benefit not only of the patient but of the society, due to the social danger that the patient could cause. And finally, we also study the case of involuntary psychiatric hospitalization due to urgency, as well as involuntary hospitalizations in geriatric or socio-sanitary centres.
